1. Scope and Validity of Terms

1.1. These terms and conditions (hereinafter the "Order Terms") apply to purchases made by the customer (hereinafter the "Customer") from the online store of Lindvior OÜ (hereinafter "NailPro"), registry code 14822846, located at Tihase 34 – 1st floor, Tallinn, Estonia, via the website www.NailPro.fi.

1.2. The Parties shall follow these Order Terms, the NailPro price list, and the applicable laws of the Republic of Estonia in their mutual relations.

2. Conclusion of the Contract

2.1. The sales contract is considered concluded once the Customer pays for the order to NailPro (Customer’s acceptance of the Sales Contract). The contract becomes effective upon receipt of payment, after which NailPro is obliged to deliver/send the goods to the Customer.

3. Prices of Goods and Services

3.1. The prices shown with the products are in euros and include VAT.

3.2. NailPro reserves the right to adjust product prices by updating them on the website. When placing an order, the Customer is guaranteed the prices that were valid at the time of placing the order.

3.3. If no price or a €0 price is shown for a product, this indicates a missing price in the database. Please contact us via phone or email for clarification. The order will be adjusted accordingly and a confirmation will be sent to the Customer as soon as possible.

3.4. Discount prices are only valid in the online store.

4. Payment and Delivery Methods

4.1. Available payment and delivery options:

Goods are delivered to the parcel terminal selected by the Customer (Smartpost or Omniva). Payment for goods and services must be made 100% in advance via bank transfer.

Note: When paying via bank link, be sure to click the "Return to merchant" button after completing the payment. Otherwise, we might not receive the payment confirmation, which may delay your order.

5. Product Availability

5.1. Product availability is indicated in the product descriptions. The data is updated regularly, but discrepancies may occur between the website and actual NailPro or supplier stock. In such cases, NailPro will notify the Customer immediately, and further steps will be agreed upon based on the Customer’s preferences and NailPro’s possibilities.

6. Right of Withdrawal

6.1. The Customer has the right to withdraw from the sales agreement within 14 days of receiving the goods.

6.2. To exercise the right of withdrawal, the Customer must send a written request to contact@nailpro.fi and return the purchased goods.

6.3. Returned goods must be unused, with all tags and packaging intact, and in the original packaging.

6.4. Electronic components may only be returned if the packaging is unopened.

6.5. If the returned product has deteriorated due to misuse, the Customer must compensate for the loss in value.

6.6. Goods made to order or customized according to the Customer’s specifications cannot be returned.

6.7. NailPro will refund the payment as soon as possible, but no later than 14 days after receiving the withdrawal request and proof of the return.

6.8. The Customer is responsible for return shipping costs.

7. NailPro’s Right to Withdraw

7.1. NailPro may cancel the sales agreement if the Customer has not paid by the due date or if the product is out of stock.

7.2. NailPro will hold the ordered goods for 30 days from notifying the Customer. Refunds will be issued upon request, minus handling, shipping, and/or storage fees.

7.3. NailPro may withdraw from the agreement if fulfilling the Sales Contract is otherwise impossible.

8. Warranty Conditions

8.1. If a product is covered by warranty, NailPro will fulfill the warranty terms by repairing or replacing the defective product as agreed.

8.2. The warranty period starts from the date of the sales agreement and is valid for the period specified by the manufacturer. The invoice is required for warranty claims.

8.3. Unless otherwise stated in the warranty terms:

8.3.1. The Customer is entitled to demand repair or replacement of the product during the warranty period.

8.3.2. The warranty period is not extended by the repair duration.

8.3.3. Replaced parts are covered by the warranty until the original warranty period ends.

8.3.4. The warranty for a replaced product also ends with the expiration of the original product’s warranty.

8.4. The warranty does not cover defects caused by mechanical damage, liquid/moisture/temperature exposure, misuse, failure to follow instructions, or natural wear and tear.

9. Complaints and Claims for Defective Products

9.1. If a hidden defect (such as a quality issue) becomes apparent, the Customer must notify NailPro immediately by email at contact@nailpro.fi and provide the following information:

9.1.1. Name and contact details;

9.1.2. Description and presumed cause of the defect;

9.1.3. Sales contract number.

9.2. The notice must be sent no later than the day after the defect is discovered. Otherwise, the Customer loses the right to claim repair or replacement.

9.3. NailPro has the right to demand the return of the defective product for replacement.

9.4. NailPro will cover the cost of replacing defective products.

9.5. If repair or replacement is not possible or fails, the Customer has the right to withdraw from the contract and return the goods. NailPro will refund the purchase within 30 days of receiving a justified withdrawal request.

9.6. NailPro is not liable for:

9.6.1. Damage caused by the Customer;

9.6.2. Defects resulting from improper storage or use;

9.6.3. Defects caused by natural wear and tear;

9.6.4. The product not meeting the Customer's expectations if there is no actual defect;

9.6.5. Other situations defined by law or the Sales Contract.

10. Liability and Force Majeure

10.1. NailPro is not liable for:

10.1.1. Errors caused by third parties affecting payments or contract formation. In such cases, the Customer must notify NailPro immediately;

10.1.2. Damages caused by unauthorized use of the Customer's identity.

10.2. Failure to fulfill obligations is excused if due to force majeure—an unforeseeable and uncontrollable event.

10.3. NailPro is not responsible for delivery delays or misunderstandings caused by incorrect Customer information or failure to receive the order.

10.4. NailPro does not compensate non-material damage, third-party non-material claims, or indirect damages (e.g., lost profits).

10.5. NailPro is not liable for obligations the Customer has taken on regarding third parties in relation to the goods.

10.6. NailPro is not responsible for damages caused by changes in delivery time, pricing, or other terms.

10.7. NailPro is not liable for damages caused by exercising the right to withdraw from the contract.

11. Retention of Ownership

11.1. Goods remain the property of NailPro until paid for in full.

12. Collection and Use of Personal Data

12.1. NailPro does not disclose Customer data to third parties, except for delivery service providers for order fulfillment.

12.2. Promotional messages will only be sent to the Customer if they have opted in.

13. Changes to Terms and Price List

13.1. NailPro reserves the right to change these terms and the price list.

13.2. Changes will be published on www.nailpro.fi and take effect upon publication.

13.3. Orders placed before the changes remain subject to the previous terms and prices.

14. Supervisory Authority and Dispute Resolution

14.1. The Consumer Disputes Committee under the Consumer Protection Board supervises agreements based on these terms. More info: helpline 1330 or +372 6201 707.

14.2. The Customer has the right to file a complaint with the Consumer Disputes Committee.

15. Final Provisions

15.1. These terms and any resulting sales agreements are governed by Estonian law.

15.2. If any provision is found invalid, the rest remain in effect. Invalid provisions will be replaced with lawful ones that most closely match the original intent. These terms remain accessible at www.nailpro.fi after the contract is concluded.
